## The number one condominium problem
Condominium conflicts over **barking dogs** are the top disputes among neighbors in Italy. Many end up in court, fines, or letters from the administrator. Sometimes it escalates to verbal violence and truly unpleasant situations.
The truth: **the law does not prohibit dogs from barking**. It does prohibit disturbances to **public peace**. Understanding this difference is crucial.
## What the law really says
The relevant regulation is **Article 659 of the Penal Code** ("Disturbance of people's occupations or rest") and the **condominium regulations**.
**Penal Code art. 659**:
> "Anyone who, through shouts or noises, or by abusing sound instruments or acoustic signals or inciting or not preventing the noises of animals, disturbs the occupations or rest of people... is punished with imprisonment for up to three months or a fine of up to 309 euros."
In summary:
- **Barking dog** = "noises of animals."
- Owner who **does not prevent** = responsible.
- Disturbance to **occupations** (day) or to **rest** (night) = crime.
**Important**: for it to be a crime, there must be:
- **Continuity** or significant frequency.
- **Disturbance to a plurality of people** (not just a grumpy neighbor).
- **Relevant times** (12-3 PM, 10 PM-7 AM are traditional "quiet" periods).
A dog barking 2-3 times a day for a few seconds **is not a crime**. A dog barking for hours every night **is**.
## Sanctions
**Penal (art. 659 CP)**:
- Fine up to €309.
- Imprisonment for up to 3 months (rare, severe cases).
**Civil**:
- Compensation for damage to neighbors (insomnia, documented stress).
- Often €500-3,000 per neighbor.
**Condominium**:
- Sanctions from the regulations (up to €200-800).
- Possible formal warning from the administrator.
**ASL/Mayor**:
- In case of **suspected mistreatment** (dog left alone for hours barking due to stress): complaint possible.
## Important rulings
**Cassation 21199/2015**:
> "To constitute a crime, the noise must exceed normally tolerable thresholds and disturb a plurality of people."
**Cassation 18039/2022**:
> "Occasional barking of a dog, even if it bothers some neighbors, does not constitute a crime. Continuous barking or barking for extended hours constitutes a crime."
**Trib. Rome 2019 ruling**:
- Dog barking 4-5 hours a day: fined €500.
**Trib. Milan 2021 ruling**:
- Dog barking for 30 seconds a day: acquittal.
So: **frequency, duration, intensity, times** are the key factors.
## What a complaining neighbor can do
**Step 1**: informal dialogue.
- Knock, speak calmly, explain the problem.
- 80% of disputes are resolved here.
**Step 2**: letter to the administrator.
- Formalize the problem.
- The administrator can call a meeting.
- Possible warning to the owner.
**Step 3**: sound measurement.
- A qualified technician measures decibels.
- Objective documentation.
**Step 4**: report to ASL/mayor.
- For disturbance of the peace.
- Civil procedure.
**Step 5**: criminal report (Prosecutor).
- For serious and prolonged cases.
- Complaint-accusation.
**Step 6**: civil lawsuit.
- Compensation for damages.
- Costs €2,000-5,000.
## The 7 ways to resolve before war
For the owner of the barking dog:
### 1. Identify why it barks
- **Boredom**: dog left alone too long without stimulation.
- **Separation anxiety**: barks when you are out.
- **Reactivity to noises**: steps in the stairwell, elevator.
- **Territoriality**: dog "defending" the balcony.
- **Excitement**: noises from neighbors, voices.
- **Health**: pain, medical issue.
Resolving the cause = resolving the barking.
### 2. Tire the dog out before leaving
- **Long walk** in the morning before work.
- **Mental play**: puzzle feeders, stuffed Kong.
- **Intense physical exercise**.
Tired dog = dog that sleeps many hours.
### 3. Mental stimulation during absence
- **Frozen Kong** with pâté + kibble: occupies 30-60 minutes.
- **Puzzle feeder**: distributes food throughout the day.
- **Snuffle mat** with treats.
- **Relaxing music** or TV with natural sounds.
An engaged dog doesn't bark out of boredom.
### 4. Reduce stimuli
- **Opaque curtains/films** if barking at passersby.
- **Move the bed** to an internal room, away from door/window.
- **Pet gate** to limit access to the balcony if barking from there.
### 5. Pet sitter or dog daycare
- Pet sitter comes 1-2 times a day.
- Dog daycare for dogs with severe separation anxiety.
- Cost: €15-40/visit or €30-60/day daycare.
Especially if you work 9-10 hours outside.
### 6. Behavioral pathway
- **Dog trainer**: works on managing barking.
- **Veterinary behaviorist**: for severe cases (diagnosed separation anxiety).
- Possible anxiolytic medication in combination.
Cost: €200-500 for the complete course.
### 7. Dialogue with neighbors
- **Inform** that you are working on the problem.
- **Ask for patience** during the process (months).
- **Update** on progress.
Reasonable neighbors will accept if they know you are working on it.
## Condominium regulations and dogs
**Important**: since 2013, **art. 1138 of the Civil Code** explicitly prohibits condominium regulations that exclude the presence of pets:
> "The rules of the regulations [...] cannot prohibit the ownership or possession of pets."
So:
- **No condominium can completely prohibit dogs**.
- **It can, however, require** correct behaviors (muzzle in the elevator, leash in the courtyard, etc.).
- **Fines for regulations** are valid only for violations of specific rules, not for owning a dog.
## The "rights of the dog" in the condominium
You, as the owner, have the right to:
**1. Own a dog**: no one can prohibit you.
**2. Walk the dog in the courtyard** (with cleaning rules).
**3. Use the elevator** (possibly with dogs over 15 kg on a leash + muzzle).
**4. Not be discriminated against** for owning a dog.
Your **duties**:
**1. Cleanliness**: pick up droppings.
**2. Safety**: dog controlled, leash in common areas.
**3. Minimum disturbance**: barking not continuous, especially during sensitive hours.
**4. Respect the condominium regulations**: muzzle, leash.
## Good practices with neighbors
- **Always greet**.
- **Introduce yourself** when you arrive (and introduce the dog).
- **Ask for tolerance** in specific cases (e.g., a newly arrived dog adjusting).
- **Communicate** if you will be absent for long periods.
- **Sincere apologies** if the dog disturbs on particular days.
Good human relationships = many fewer formal conflicts.
## When the other wrong is you
Recognize if you have a real problem:
- Dog barks **2+ hours a day** consecutively.
- Neighbors have **small children** who cannot rest.
- Multiple neighbors are complaining (not just one).
- The dog is left alone **8+ hours a day**.
In these cases: your dog is **suffering** (in addition to causing disturbance). Resolving it is good for everyone.
## The judicial route
If neighbors sue:
- **Document** your commitment (veterinary reports, trainer invoices, recordings of the dog being quiet during verified presences).
- **Sound measurements** are crucial: request measurements from the opposing party.
- **Witnesses** who can attest that the dog does not bark as claimed.
- **Expert lawyer** in condominium matters.
Defense cost: €1,500-4,000.
## The final solution
**Dialogue** is the best strategy.
**Working on the dog** is the real solution.
**Mutual respect** avoids legal wars.
A dog that barks problematically is almost always an **unhappy dog**. Caring for its unhappiness makes neighbors happy too, and you avoid weeks of unnecessary tension.
Invest in your dog, and the condominium remains a peaceful place for everyone.
